These Terms of Service govern your use of zayleads.com and the services provided by Zayleads ("we," "us," or "our"). By using our website or services, you agree to these terms.

1. Services

Zayleads provides lead capture, follow-up automation, and CRM system setup and management services for home service contractors. Our services include AI-powered text response systems, pipeline management, automated follow-up sequences, and related services as described on our website.

2. Service Agreement

Use of our services requires a separate written service agreement. Pricing, deliverables, and terms specific to your engagement will be outlined in that agreement. These Terms of Service apply generally to use of this website and initial engagement with Zayleads.

3. SMS Communications

By providing your phone number and submitting our contact form, you consent to receive SMS text messages from Zayleads. These messages are related to your service inquiry and our business communications.

  • Message and data rates may apply
  • Message frequency varies based on your engagement with our services
  • Reply STOP to opt out of SMS messages at any time
  • Reply HELP for assistance or contact [email protected]
  • Opting out will not affect your ability to receive services

4. Payment Terms

Service fees are outlined in your individual service agreement. Setup fees are due as follows: 50% upon signing, 50% upon system going live. Monthly service fees are billed on the first of each month. All fees are non-refundable except as specified in our guarantee.

5. Our Guarantee

If your average lead response time does not reach under 5 minutes within 30 days of your system going live, your first month's service fee will be refunded. This guarantee applies only to system performance and not to factors outside our control, including but not limited to client-side technical issues, account access problems, or internet connectivity.

6. Client Responsibilities

To receive our services you agree to:

  • Provide accurate business information and timely access to required accounts
  • Respond to onboarding requests within reasonable timeframes
  • Use our services in compliance with applicable laws and regulations
  • Not use our services for spam, illegal activity, or harassment

7. Intellectual Property

All content on zayleads.com including text, design, and code is owned by Zayleads. Custom workflows, templates, and systems built for your account remain your property upon full payment. You may not resell or redistribute our proprietary methodologies without written permission.

8. Limitation of Liability

Zayleads is not liable for indirect, incidental, or consequential damages arising from use of our services. Our total liability is limited to fees paid in the 30 days preceding any claim. We do not guarantee specific business outcomes including revenue increases or lead conversion rates.

9. Termination

Either party may terminate the service relationship with 30 days written notice after the initial service period. We reserve the right to terminate services immediately for violations of these terms.

10. Governing Law

These terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes will be resolved in Monroe County, Pennsylvania.

11. Changes to Terms

We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the updated terms.
